Russ,

I agree with your recent explainations with the following exception:
While Colorado will not reimburse you more than you have paid them in a tax year, I do believe the tax credit in CO can be carried over to subsequent years until it is used up. On the bottom of page 2 of the 2000 CO Form 104CR - Individual Credit Schedule, there is a spce to list carried over credits for the next tax year, and the limitation below that states, "Most unused 2000 credits may be carried over to and claimed on your 2001 Colorado income tax return." The instructions basically say to do just that.

James

Colorado forms DR 0166, DR 0167 and DR 0168 relate to the alternative fuels rebate in Colorado. Form DR 0166 lits the "Qualified entities" as state and local governments or "a person, organization, or other nongovernmental entity that is exempt from Federal Income taxation..." Form DR 0167 has a place to check what type of qualifying entity is applying (nothing for individuals) and form DR 0168 is just a dealer certification to accompany the others. Unless I'm missing something, I don't think this rebate applies to indviduals.

Todd Hackett

Actually, the Colorado State credit does apply to individuals. I spoke with someone at the Colorado State Dept of Revenue 3 months ago to verify.

--Russ Carver

Here's the missing piece to the puzzle:

www.revenue.state.co.us/fyi/html/income09.html

Key phrase:

For tax years beginning on or after July 1, 2000, alternative fuel vehicles used by individuals for personal use also qualify for this credit.

The forms that were mentioned in a previous post (Colorado forms DR 0166, DR 0167 and DR 0168) apply to the alternative fuels rebate (different than the credit). The rebate is for government and tax-exempt entities, while the credit was originally for business but applies to individuals starting this tax year. Information on the credit is at:
http://www.revenue.state.co.us/fyi/html/income09.html
The definition of alternative fuel vehicle for the credit is fairly specific, and I don't know whether the Prius would qualify. Also, the amount of the rebate varies depending on the "certification level" with ULEV getting 75% of the incremental cost, and SULEV getting 85%. I've seen the Prius listed as a SULEV, but I've also seen that rating only being applied in certain areas (such as California). I don't see anything on mine or in the documentation that gives an emissions rating. Are all Prii classified as SULEV?

Yes, all Prii are classified as SULEV. I have submitted the claim for the Colorado credit already since I bought my Prius last year. I received the check from the state a couple months ago so I have the cold hard cash to confirm that this is a real deal!

I should mention that the state revenue staff was quite confused by my claim as an individual apparently I was the first Personal Use claim they saw!! Maybe not too surprising since I filed very early this year...who wouldn't with that kind of refund coming, eh?!?
